PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU SHOULD NOT REGISTER FOR THE YOUTH SPORTS MEDIA, INC. IN IT TO EARN IT™ (IITEI) PROGRAM OR ANY OF THE SERVICES, ACTIVITIES, CONTENT, AND FEATURES AVAILABLE THROUGH IT. BY REGISTERING FOR IITEI , YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY AND CAPACITY TO CONSENT TO THESE TERMS AND CONDITIONS IN THEIR ENTIRETY AND YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND FULLY ACCEPT AND AGREE TO ALL OF THESE TERMS AND CONDITIONS. PLEASE PRINT AND KEEP A PAPER COPY AND/OR RETAIN AN ELECTRONIC COPY OF THESE TERMS AND CONDITIONS FOR YOUR RECORDS.
In It to Earn It™ is a funding program of Youth Sports Media, Inc. (YSM) created for the benefit of 501(c)(3) local non-profit youth sports leagues. The In It to Earn It™ (IITEI) program provides funding to qualifying youth sports leagues who register in the IITEI program. Funding for each registered league is then earned by that league when their players, parents or legal guardians and coaches become free members of YSPN360.com and access the instructional and educational sports content on that web site.
Leagues: Leagues are defined as; All local non-profit youth baseball, softball, and soccer leagues and league organizations (leagues) located within a county, metro area, city or township in the United States with 501(c)(3) federal tax status are eligible to register and participate in the YSM In It to Earn It™ (IITEI) program. National youth sports governing bodies are not eligible to register or earn funds from YSM through the IITEI program.
Participants: All players, their parents or legal guardians, and coaches who are active participants in an eligible League registered with IITEI after January 1, 2018 are eligible to register in the IITEI program. Funds distributed to leagues during this part of the IITEI program will be based only on registration by registered players.
Please carefully read the Terms and Conditions for INDIVIDUAL REGISTRATION, LEAGUE REGISTRATION and PARTICIPATION below.
Registration for the IITEI program at YSPN360.com by qualifying local youth sports leagues and organizations as defined above will begin on January 1, 2018. All league and individual IIETI program memberships by participating players, parents or guardians, and coaches of registered teams must be completed by April 1, 2018.
In order for a youth baseball, softball, or soccer league to become eligible to receive funds from YSM, the league must register as an IITEI participating league. League IITEI Registration is available only at the YSPN360.com web site where a special IITEI youth league Registration Page has been established. Registration instructions are provided on the YSPN360.com web site. When each league’s eligibility is verified, that registered youth league will receive a unique League Identification Number (League ID) from YSM.
After a qualifying non-profit league is registered with IITEI, the participating players, parents or guardians, and coaches of that league must register for a free YSPN360.com membership and enter their league’s unique League ID number where indicated. 10% of the league’s players, parents and coaches must be members of YSPN360.com for their league to receive funding. If a team player, parent or coach of a registered youth league is already a member of the YSPN360.com web site, that individual must sign up again to participate in the IITEI program, using their league’s unique LEAGUE ID number.
PARTICIPATION AND FUNDING:
Leagues that complete their IITEI registration will become eligible to receive funds for each registered youth league player, parent or guardian, and coach who signs up for YSPN360.com membership through the IIETI web page. However, the maximum distribution of IITEI funds from YSM to a registered league may not exceed the total funds per registered player in that league prior to April 1, 2018, notwithstanding the total number of individual IITEI registrations received from players, parents or guardians and coaches using that registered league’s unique League ID number.
– Example: If a registered league in the IITEI program signs up 400 players before April 1, 2018 along with that league’s coaches and parents, distribution of funds to the league will be based on the player registrations only. Parents and coaches who also register become free members of YSPN360.com with access to all content.
Membership eligibility in the IITEI program will be determined by individual e-mail address and inclusion of the appropriate unique League ID number. Each IITEI member must be registered from a separate e-mail address. Individual membership registration must include the unique League ID number, which may be obtained from the league office or team coach. All individual memberships must be completed by April 1, 2018 to qualify for league funds.
Upon registration, each respective league agrees that funds provided to the registered leagues by YSM under the IITEI program are charitable contributions and are not paid in kind for any benefit provided for or to respective leagues or in exchange for any free web site content access under the registration agreement of individual YSPN360.com memberships. YSM reserves the future right to change, modify, or extend the dates, requirements and funding structure of the IITEI program.
DISTRIBUTION OF FUNDS:
Fund distribution from YSM to registered leagues will be made on or around June 1, 2018 directly to each respective registered league for all qualifying YSN360.com league memberships accrued by that league as of April 1, 2018.
Please Note: All earned league funds from member participation in the IITEI program will accrue beginning with the first member signup from each league.. Each league’s quarterly payments will begin when a minimum of $25 is earned by participating member registrations. Distribution of all funds will be made. If $25 is not achieved by the end of a calendar quarter, a league’s funds will be accrued until $25 in member signups has been earned.
USE OF FUNDS:
There are no restrictions on use of funds by registered leagues or league organizations once they are received, except where state or local regulation of the use of charitable donations applies. Each youth sports league should check these regulations before registering with the IITEI program.
The IITEI program is open to all non-profit baseball, softball and soccer leagues located in the United States. All IITEI-registered members of YSPN360.com are required to provide truthful information and YSM will reject and delete any registration that it determines to be false or fraudulent. YSM may disqualify any league from payment of IITEI funds accrued from individuals who do not meet the eligibility requirements of team membership of that registered league. YSPN360.com memberships by players, parents and coaches from leagues not registered with IITEI will not be eligible to earn funds, and registered leagues who solicit YSPN360.com memberships from individuals outside of their respective leagues will automatically waive their distribution of funds that may have accrued through the IITEI program.
PROMOTION BY YSM OF REGISTERED LEAGUES:
By participating in the IITEI program, each qualifying league agrees to allow its name, logo, and other graphic likeness to be used on the YSPN360.com web site in conjunction with material related to the IITEI program without limitation and without further compensation during the term of the IITEI program. Registered Leagues may e-mail their logo or identifying graphic to info@YSPN360.com.
By agreeing to these terms and conditions, youth sports leagues registered in the In It to Earn It™ program agree to hold harmless YSM, its affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns against any and all claims or liability arising directly or indirectly from participation in the IITEI program. YSM is not responsible for telephone or mobile service outages, delays, equipment malfunctions from third-party digital service providers, or any other technical difficulty that may prevent a league or individual from completing his/her registration, or for registrations not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technical difficulties.
YSM makes no representation or warranty that the content and information provided in the IITEI program and on the YSPN360.com web site are appropriate or available for use outside the United States. No youth sports league registration from those locations will be accepted.
You agree that YSNIM, in its sole discretion, may terminate the use of the YSPN360.com web site by a register league and its members, and remove and discard any content within the YSPN360.com web site, at any time and for any reason. You agree that any actions taken under this Section may be effective without prior notice to you.
The relationship between a registered youth sports league and YSM shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Registered sports leagues and YSM irrevocably agree to submit to exclusive jurisdiction of the federal and state courts located within the county of Los Angeles, in the State of California, and waive any jurisdictional, venue or inconvenient forum objections to such courts.
The failure of YSM to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severed therefrom and shall not affect the validity and enforceability of any remaining provisions.
If YSM or its assets are acquired by another entity, that entity will assume YSM’s rights and obligations as described in these Terms & Conditions. A registered league or individual member may not assign any of its rights or obligations under these Terms & Conditions, by operation of law or otherwise, without YSM’s prior written consent.
YSM reserves the right to cancel, terminate or change the IITEI program without limitation, including as a result of infection by computer virus, tampering, unauthorized intervention or technical failure. If a registered league disagrees with cancellation, termination or changes, then continued access or use of the YSPN360.com web site following such notice signifies acceptance of such termination or changes. YSM will not be liable to you or any third party should YSM exercise its right to modify or discontinue the Site or Services.
